ChatGPT vs Claude vs Mistral: which is GDPR-safe in 2026?

Quick answer (checked September 2026): Data residency is now the deciding factor, and the vendors differ more than their marketing suggests. Mistral is a French company with EU-hosted services. OpenAI offers EU data residency on ChatGPT Enterprise, Edu and its API. Anthropic's own Claude API and apps process data in the US or "global" only — for Claude in an EU region you go through Amazon Bedrock or Google Cloud. For personal data, pick the deployment route first, then the model.

"We want to use AI, but which one should we actually pick?"

This is the single most common question Luxembourg business owners ask when they start exploring AI implementation in Luxembourg. The model you pick matters less than it did a year ago — the frontier models from OpenAI, Anthropic and Google now leapfrog each other every few months. What has not converged is where your data goes. That is the question a Luxembourg firm with client data has to answer first, and it is the one most comparisons skip.

The three questions to ask before you compare models

Every time we scope a deployment for a Luxembourg client, we ask three questions before anyone mentions a model name:

1. Where does inference run? This means the data centre that processes the prompt, not where the company is headquartered.
2. Where is data stored at rest? Chat history, uploaded files and logs all count.
3. What makes the transfer lawful if data leaves the EEA? For the US, this is either the recipient's certification under the EU-US Data Privacy Framework or Standard Contractual Clauses.

A model that is excellent but answers these badly is the wrong choice for client data. A slightly weaker model that answers them well is usually the right one. The four routes below are just the four possible answers.

The four deployment routes that matter

1. Frontier cloud AI, hosted by the vendor (ChatGPT, Claude, gemini)

What it is: You use the vendor's own app or API — ChatGPT, claude.ai or the Claude API, Gemini.

Where your data goes — this is where the vendors differ:

• OpenAI introduced data residency in Europe in February 2025. It covers ChatGPT Enterprise, ChatGPT Edu and the API Platform. Consumer ChatGPT and smaller business plans do not come with that guarantee, so check your plan.
• Anthropic's own data residency controls currently offer only two inference locations: "us" and "global". The only workspace storage location is "us". There is no EU option on Anthropic's first-party Claude API or apps today.
• Google Gemini in consumer and Workspace form follows Google's own terms. For a pinned region, businesses use Gemini through Google Cloud (route 2).

Best for: General productivity — drafting, summarising, research — where no client personal data is involved. Use it for client data only on a plan with a contractual EU residency commitment.

Strengths: The most capable general-purpose models and the largest integration ecosystems. Claude remains our first choice for careful business writing, contract review and document analysis — see what Claude can do for Luxembourg businesses.

Limitations: EU residency is plan-dependent or, for Anthropic's own services, not available. Data residency is also not the same as EU jurisdiction: the provider is still a US company.

2. A frontier model inside an EU cloud region (bedrock, Google cloud, azure)

What it is: You access the same frontier models through a hyperscaler you already contract with, and pick an EU region. Anthropic's documentation notes that on Amazon Bedrock and Google Cloud, the inference region is set by the endpoint or inference profile you choose, not by Anthropic's inference_geo setting.

Best for: Fiduciaries, law firms, PSFs and fund service providers that want Claude-class quality with inference inside an EU region, under an existing cloud contract and DPA.

Limitations: Not every model version reaches every EU region on day one. The setup is technical: IAM, logging and network controls. You still have a US-headquartered provider in the chain, so the transfer analysis below still applies.

3. A European provider (Mistral)

What it is: Mistral AI is headquartered in France and offers Le Chat and its La Plateforme API from EU infrastructure. It also publishes open-weight models you can run yourself (route 4).

Best for: Businesses that want an EU company under EU jurisdiction, and strong French and European-language output — an advantage in Luxembourg's trilingual environment.

Limitations: A smaller integration ecosystem than OpenAI or Microsoft. On the hardest reasoning tasks, benchmark positions change release by release. Test Mistral on your documents rather than relying on a leaderboard snapshot.

4. Open-weight models and private deployments

What it is: Open-weight models (the Llama, Mistral and DeepSeek families, among others) running on your own servers, a Luxembourg data centre or a dedicated EU cloud instance. Best for: Banking, fund administration, healthcare, M&A — anything where data must not leave an environment you control.

Strengths: Maximum data sovereignty. It can be adapted to your own data and has no per-seat fees. Luxembourg businesses can access subsidised GPU compute through MeluXina and the AI Factory. Funding through SME Packages AI and Fit 4 AI can offset part of the project cost.

Limitations: Open-weight models trail the best proprietary models on the hardest tasks. You own operations, patching and monitoring. The upfront cost is higher.

GDPR in September 2026: what actually applies

• Transfers to the US are not automatically unlawful. The Commission's adequacy decision for the EU-US Data Privacy Framework (Implementing Decision (EU) 2023/1795) applies to US recipients certified under it. The EU General Court dismissed the challenge to it on 3 September 2025 (Case T-553/23, Latombe v Commission). An appeal is pending before the Court of Justice (Case C-703/25 P), so treat the DPF as valid but not permanent. Keep Standard Contractual Clauses as a fallback where your provider offers them.
• EU data residency reduces transfers but does not remove the provider's nationality. A US provider running EU data centres is still subject to US law. For most SME use cases, residency plus a proper DPA is a proportionate answer. For banking secrecy or medical data, it is the reason route 4 exists.
• Your own obligations do not move. A Data Protection Impact Assessment (DPIA) where the processing is high-risk under GDPR Article 35, a record of processing, and staff instructions on what may be pasted into which tool all apply whichever model you choose.

A decision framework for Luxembourg businesses

No personal or confidential data, general productivity: Any frontier model on a business plan. Pick the one your team will actually use.

Client personal data, standard sensitivity: Use a plan or route with a contractual EU residency commitment. That means ChatGPT Enterprise or the API with European residency, Claude through Bedrock or Google Cloud in an EU region, or Mistral.

Banking secrecy, fund data, health data, M&A: Use a private deployment or open-weight models on infrastructure you control, with frontier cloud models limited to non-sensitive work.

Most Luxembourg SMEs end up with two tiers: a frontier assistant for everyday work, and a controlled route for the processes that touch client data.

What happens when you choose wrong?

The costly mistake is rarely the model. It is sending client data through a route whose data flow nobody checked. Examples are a consumer ChatGPT account used for client files, or an assumption that "Claude is EU-hosted" when the account is on Anthropic's US-only first-party API. A firm that over-corrects and buys a private deployment for tasks a standard business plan could handle wastes budget and slows adoption just as surely.

FAQ: choosing an AI model in Luxembourg

Is ChatGPT GDPR-compliant for Luxembourg businesses?

It can be, depending on the plan. Since February 2025 OpenAI has offered data residency in Europe for ChatGPT Enterprise, ChatGPT Edu and the API. That, together with a data processing agreement, is the setup to use for client personal data. Consumer and small-team plans do not carry the same residency commitment, so keep client personal data out of them.

Is Claude hosted in the EU?

Not through Anthropic's own services, as of September 2026. Anthropic's data residency documentation lists only "us" and "global" for inference, and "us" for storage. To run Claude inference in an EU region, use it through Amazon Bedrock or Google Cloud and select an EU region there.

Which AI model handles french, german and english best?

All current frontier models handle FR/DE/EN business writing well. Mistral, built in France, is particularly strong in French and is an EU company with EU hosting.
